End User License Agreement (EULA)
IMPORTANT — READ CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE.
This End User License Agreement (“Agreement”) is a legal contract between you (either an individual or a legal entity, “You” or “User”) and PCandPrinter (a wholly owned subsidiary of Allroundfix LLC) regarding the software provided by PCandPrinter, including any related components, media, printed materials, and electronic documentation (collectively, the “Software”). By installing, copying, or otherwise using the Software, you agree to be bound by the terms of this Agreement.
If you do not agree to all terms, do not install or use this Software.
Section 1. Intellectual Property Rights
The Software and all associated intellectual property rights are owned by PCandPrinter or its licensors. You acknowledge that title to the Software remains with PCandPrinter and that no ownership rights are transferred to you under this Agreement. You may not reproduce, distribute, modify, or create derivative works from the Software unless expressly permitted in writing by PCandPrinter.
Section 2. License Grant and Restrictions
PCandPrinter grants you a limited, non-exclusive, non-transferable license to install and use the Software on a single computer for your personal or internal business purposes. You may make one backup copy for archival purposes only.
You agree that you will not:
- Rent, lease, sublicense, or distribute the Software;
- Use the Software on a network allowing simultaneous use by multiple devices;
- Reverse engineer, decompile, or disassemble the Software beyond what is permitted by applicable law;
- Remove or alter any proprietary notices on the Software.
This license is subject to your compliance with this Agreement.
Section 3. Limited Warranty
For a period of 30 days from the date you first install and activate the Software (“Warranty Period”), PCandPrinter warrants that the Software will substantially operate as described in its accompanying documentation. If you encounter issues and report them during the Warranty Period, PCandPrinter may, at its discretion, repair or replace the Software or issue a refund for the license fee you paid.
Section 4. Warranty Disclaimer
EXCEPT AS EXPRESSLY SET FORTH ABOVE, THE SOFTWARE IS PROVIDED “AS IS,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. PCandPrinter DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Section 5. Disclaimer of Consequential Damages
PCandPrinter SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE. This includes, without limitation, loss of data, lost profits, or business interruption, even if PCandPrinter has been advised of the possibility of such damages.
Section 6. Limitation on Liability
To the extent permitted by law, PCandPrinter’s total liability under this Agreement shall not exceed the amount you paid for the Software license.
Section 7. Export Control
You agree to comply with all applicable export laws and regulations regarding the distribution or transfer of the Software.
Section 8. Taxes
You are responsible for paying any applicable taxes related to your purchase or use of the Software.
Section 9. Government Users
If You are a government entity or representative, the Software is provided with restricted rights, and use, duplication, or disclosure by the government is subject to applicable regulations.
Section 10. Termination
This Agreement will terminate immediately if you fail to comply with any terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
Section 11. General Terms
This Agreement is governed by the laws of the state where PCandPrinter is incorporated. If any provision is found unenforceable, the remainder will remain in effect. This document constitutes the entire agreement between you and PCandPrinter regarding the Software.
Section 12. Claims Resolution
If a dispute arises, you agree to first attempt resolution through PCandPrinter support. If unresolved, disputes may be subject to mediation or arbitration as specified by PCandPrinter’s policies.
Section 13. Miscellaneous
This Software may include features that require display elements during installation. PCandPrinter may update installation processes or scheduled tasks as needed.
Section 14. Refund Policy
PCandPrinter may offer refunds under specific conditions and within a defined refund period. Eligibility and procedures will be provided in PCandPrinter’s official refund policy.
